1984 CHAPTER 6

An Act to enable the Secretary of State to control the use of dangerous materials or apparatus in educational establishments in Scotland. [13th March 1984]

BE IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:-

1 Secretary of State's power to control use of dangerous materials or apparatus in educational establishments

The following section shall be inserted after section 19 of the Education (Scotland) Act 1980 (c. 44) -

"19A Secretary of State's power to control use of dangerous materials or apparatus in educational establishments

(1) The Secretary of State may by regulations make provision for requiring his approval to be obtained for the use in such educational establishments as may be specified in the regulations of such materials or apparatus as may be so specified, being materials or apparatus which could or might involve a serious risk to health.

(2) The power referred to in subsection (1) above includes power to make different provision in respect of different educational establishments."

2 Short title and commencement

This Act may be cited as the Education (Amendment) (Scotland) Act 1984 and shall come into force at the end of the period of two months beginning with the day on which it is passed.
