Education (Deaf Children) Act 1937

Section 51(2) of the 1921 Education Act required the parents of a blind and/or deaf child to ensure that s/he received elementary education, 'except in the case of a deaf child under seven years of age'.

This brief Act amended that clause to remove the words 'except in the case of a deaf child under seven years of age'.

An Act to lower the age at which the period of compulsory education begins in the case of deaf children. [29th April 1937.]

BE it enacted by the King's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:-

1 Amendment of 11 & 12 Geo. 5. c. 51, s. 51

The fact of a child who is under seven years of age being deaf shall not of itself be a reasonable excuse for not causing the child to attend school, or for neglecting to provide efficient elementary instruction for the child; and accordingly in subsection (2) of section fifty-one of the Education Act 1921 (hereinafter referred to as "the principal Act"), the words "(except in the case of a deaf child under seven years of age)" are hereby repealed.

2 Short title, construction, commencement and extent

(1) This Act may be cited as the Education (Deaf Children) Act 1937, and shall be construed as one with the principal Act and this Act and the Education Acts 1921 to 1936, may be cited together as the Education Acts 1921 to 1937.

(2) This Act shall come into operation on the first day of April, nineteen hundred and thirty-eight.

(3) This Act shall not extend to Scotland or Northern Ireland.
